A company taking part in corporate conflict alienated the registered trade marks in favour of a certain offshore company. The lawyers of PRESIDENT CONSULT disputed this transaction on the transfer of trade marks as a bad faith transaction. As a result of investigation of circumstances of the case, some documents were revealed which obviously supported the position of the claimant. Also a relevant expertise was carried out and only confirmed the actual market value of the alienated property. As a result, a conspiracy of parties to the transaction aimed against the interests of the legal entity, one of the participants which is our client, was proved in court. The court declared the transaction as invalid and resolved that illegally alienated rights for intellectual property are to be returned to their initial owner.
